This Digital Privacy Charter ("Policy") outlines how 0209AI ("Company," "we," "us," or "our"), the developers, owners, and operators of the FindMeDrivers technology platform (available via https://findmedrivers.com/ and associated mobile applications), collects, handles, encrypts, and processes personal data. This Policy is designed in strict compliance with the **Digital Personal Data Protection (DPDP) Act, 2023** (India), the **Information Technology Act, 2000**, and the rules promulgated thereunder.
By registering on, accessing, or using the FindMeDrivers platform as a registered Vehicle Owner ("Owner") or independent Car Driver ("Driver"), you explicitly consent to the collection, tracking, storage, and processing of your personal data, including real-time GPS telemetry and vehicle diagnostics, as specified in this Policy.
2. Digital Personal Data We Collect
To enable premium matching and ensure elite safety parameters, we collect the following categories of digital personal data:
- Identity & Registration Credentials: Full name, verified mobile number, active email address, physical address, and profile photographs. For Drivers, we additionally collect and verify Government-issued identification, active permanent Commercial Driving Licenses, and background screening logs.
- Vehicle Metadata: Odometer readings, manufacturer model specifications, registration certificates (RC), valid insurance cards, and general fuel/tire pressure metrics logged during the pre-trip check-in audit.
- Real-Time Location & GPS Telemetry: Precise continuous geographic location coordinates of both Owners and Drivers. This telemetry tracking is active from the moment a Driver accepts a matched booking request until the complete check-out/handback procedure is logged in-app.
- Safety & Driving Telemetry: Continuous motion sensor logs, including speed patterns, hard deceleration/acceleration events, turn telemetry, route compliance, and dispatch latency.
- Financial Logistical Data: Account billing details, transaction histories, online payment receipts processed through our premium gateways, and outstation surcharge exclusions.
3. Processing Purpose and Legal Basis
We process your digital personal data under the lawful grounds of **Explicit Consent** and **Contractual Necessity** to:
- Facilitate Premium Matchmaking: Match Owners' dynamic travel needs with certified, skilled independent drivers according to vehicle transmission specifications.
- Provide FindMeDrivers Shield Protection: Verify odometer and vehicle tire photos logged during check-in audits to validate active damage claims.
- Enforce Telemetry-Based Safety: Monitor continuous driving telemetry, speed thresholds, and route consistency to maintain premium standards and protect passenger lives.
- Grievance & Incident Resolution: Coordinate dynamic highway outstation modifications, processing of outstation allowance exceptions, and direct customer dispute escalations.
4. Explicit Consent & Telemetry Tracking Disclosures
Owner Location and Telemetry Consent: Owners explicitly consent to continuous GPS tracking on their devices to enable concierge matching and coordinate real-time Driver arrival details.
Driver Location and Telemetry Consent: Drivers explicitly consent to active background location tracking, routing metrics, and mechanical speed telemetry whenever marked as "Online" or executing an active trip. Driving telemetry is analyzed in real-time. Extreme speed violations or bypass maneuvers result in immediate matching restrictions and platform blacklist under Murtizapur/Akola jurisdiction.
5. Data Storage, Encryption & Security Safeguards
All personal data is processed using industry-standard secure channels. We employ the following technical safeguards:
- AES-256 Bit Encryption: Applied to all database records at rest and secure SSL/TLS protocols for all transactional data in transit.
- Retention Boundaries: Data is stored securely on servers and is retained only as long as necessary to fulfill the operational matching contract, defend legal compliance, or satisfy statutory record-keeping periods under Indian law.
- Strict Intermediary Access: Only pre-screened technical operations personnel within the 0209AI technology environment can access raw telemetry logs to coordinate active security checks.
6. Your Rights Under the DPDP Act, 2023
Under the Digital Personal Data Protection Act, 2023, you hold key rights regarding your personal data:
- Right to Access and Summary: You may request a complete summary of your personal data processed by FindMeDrivers.
- Right to Correction & Erasure: You can request correction of inaccurate data, updates to dynamic info, or the permanent deletion (erasure) of your active profile. *Note: Data required for resolving active dispute claims or satisfying Murtizapur/Akola court subpoenas is exempted from immediate erasure.*
- Right to Withdraw Consent: You may withdraw your location tracking consent at any time through system settings; however, doing so will immediately terminate platform booking capabilities due to technology limitations.
- Right to Nominate: You have the right to nominate another individual to exercise your privacy rights in the event of death or physical incapacity.
7. Grievance Redressal Mechanism
If you have any inquiries, complaints, or seek to exercise your erasure rights under the DPDP Act, 2023, please contact our designated Grievance Officer immediately. We are committed to acknowledging your concern within 48 hours and resolving it within the statutory timeline.
