Terms & Conditions for Car Drivers

1. PLATFORM ROLE AND DISCLAIMER

FindMeDrivers, owned by 0209AI, is a technology platform that acts as an intermediary to connect independent drivers with car owners. You acknowledge that the Company is not a transportation provider and does not function as a carrier. We do not own, lease, or maintain vehicles. All driving services are provided by you as an independent contractor, and FindMeDrivers disclaims any liability arising from the performance of your duties.

2. NO EMPLOYMENT RELATIONSHIP

You expressly acknowledge and agree that your relationship with 0209AI is strictly that of an Independent Contractor.

• This agreement does not create any partnership, joint venture, agency, or employment relationship.
• You are not an employee of the Company and are not entitled to any benefits provided to employees, including but not limited to Provident Fund (PF), ESI, Gratuity, Bonus, or paid leave.
• You have the total discretion to accept or reject a trip request through the platform.

3. DRIVER RESPONSIBILITIES AND COMPLIANCE

You represent that you are at least 18 years of age and possess a valid Indian Driving License (LMV) and [Aadhaar Redacted] card. You agree to:

• Comply with all applicable traffic laws, RTO regulations, and speed limits.
• Maintain a high standard of professional conduct, including punctuality and polite communication with car owners.
• Not drive under the influence of alcohol, drugs, or any substance that impairs judgment.
• Ensure that you are mentally and physically fit to operate a motor vehicle at the time of accepting any service request.

4. DOCUMENT ACCURACY & UPDATES

You warrant that all information, documents, and photographs provided during registration are true, accurate, and belong to you. You are responsible for maintaining the validity of your Driving License. If your license is expired, suspended, or cancelled by the authorities, you must stop using the app immediately and inform FindMeDrivers. Failure to provide updated documents will result in immediate account deactivation.

5. LIABILITY AND INDEMNITY

You are solely liable for any claims, accidents, injuries, or fatalities that occur while you are in control of a vehicle assigned through the platform. You agree to indemnify, defend, and hold harmless 0209AI, its directors, and employees from and against any and all losses, liabilities, expenses, and damages (including legal fees) arising from:

• Your negligence or reckless driving.
• Any breach of these Terms and Conditions.
• Any violation of third-party rights or local laws.

6. DISPUTES WITH CAR OWNERS

FindMeDrivers is not responsible for any disputes that may arise between you and the Car Owner. Whether the dispute is related to the vehicle's condition, the owner's behavior, or payment of the fare, it must be resolved directly between you and the owner. The Company will not act as a mediator or arbitrator in these personal or financial disagreements.

7. TRIP FARE AND PAYMENT TERMS

You agree to the fare structure calculated by the FindMeDrivers App.

After each trip:

• You must collect the full fare directly from the car owner(cash or online payment based on mutual convenience).
• Trip Fare Includes:
• Base fare for driving time
• One-way return fee (if applicable)
• Night charges (if applicable)
• 10% platform fee on:(base fare + return fee + night charge)
• 18% GST on the platform fee

Payment to FindMeDrivers

Before receiving the next trip:

• You must clear the 10% platform fee + 18% GST on the platform fee.
• Trips will not be assigned until dues are paid.

8. SUSPENSION OR TERMINATION OF ACCOUNT

FindMeDrivers reserves the absolute right to suspend or terminate your account without prior notice if:

• You provide inaccurate or fraudulent documents.
• You receive consistently low ratings or serious complaints regarding safety or behavior.
• You engage in "Offline Bookings" by soliciting customers found through the app to book you directly, causing a loss of platform fees to the Company.
• You violate any safety protocols or local laws.

9. NO WARRANTY

We provide the platform "As-Is" and "As-Available." We do not guarantee that the application will always be available or that you will receive a minimum number of trip requests. We make no warranties regarding the accuracy of the GPS/Map data provided within the app or the background/reliability of the Car Owners.

10. INTELLECTUAL PROPERTY

The FindMeDrivers name, logo, application design, software, and website content are the exclusive intellectual property of 0209AI. You are granted a limited, non-exclusive license to use the app for its intended purpose. You shall not copy, modify, distribute, or reverse-engineer any part of the platform.

11. UNAUTHORIZED USE

You agree not to use the platform for any illegal or unauthorized purpose. You shall not share your login credentials with any other person. Any attempt to use the platform to transport illegal goods, contraband, or for any criminal activity will result in immediate termination and reporting to the authorities.

12. THIRD-PARTY LINKS

The application may contain links to third-party services, such as Google Maps or payment gateways. FindMeDrivers does not control these third parties and is not responsible for their content, accuracy, or privacy practices. Your use of these links is at your own risk.

13. REFUND POLICY

Payments made to the Company toward platform fees or wallet top-ups are non-refundable. In the event of a technical error where a payment was deducted but not credited to your account, you may raise a support ticket within 48 hours for a resolution.

14. FORCE MAJEURE

FindMeDrivers shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15. GOVERNING LAW

These Terms and Conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India.

16. JURISDICTION

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Murtizapur/Akola, Maharashtra.

17. TECHNICAL ERRORS AND MALFUNCTIONS

FindMeDrivers does not guarantee that the website or application will be free from bugs, viruses, or technical malfunctions. We are not responsible for any losses incurred due to the inaccuracy of the app's location tracking, timing, or fare calculation due to technical errors.

18. COMMUNICATIONS

By registering, you give express consent to FindMeDrivers and 0209AI to contact you via Phone Calls, SMS, WhatsApp, and Push Notifications for purposes including booking alerts, payment reminders, and promotional offers

19. ONE-WAY TRIP & RETURN LOGISTICS

For one-way trips, the Driver is entitled to a "Return Logistics Fee" to cover the cost of their return journey via public transport. You agree to finalize this amount with the owner as per the app's suggestion before the trip commences. You are responsible for your own safety and travel arrangements during the return leg of a one-way trip.

20. TRAFFIC VIOLATIONS AND E-CHALLANS

Any traffic fine, penalty, or e-challan issued by the authorities during the duration of the trip (from the time you take the keys to the time you hand them back) is your personal financial responsibility. If the Car Owner pays the fine to clear their vehicle record, you are legally bound to reimburse them immediately.

21. VEHICLE HANDOVER INSPECTION

Before starting any trip, the Driver must perform a basic inspection of the vehicle for existing damages (dents/scratches) and mechanical issues. It is advised to take photos or videos of the vehicle before starting. If the vehicle is found to be in an unsafe condition (e.g., failed brakes or bald tires), you must decline the trip and report it to FindMeDrivers support.

22. ZERO TOLERANCE: SAFETY AND SUBSTANCES

FindMeDrivers maintains a zero-tolerance policy regarding the use of alcohol, tobacco, or any illegal substances while on duty. Any reported instance of a driver being under the influence will result in an immediate permanent ban and the sharing of your [Aadhaar Redacted] and License details with the local police for legal action.
